SOME FOOD PRODUCTS FEATURED MAY CONTAIN NUTS OR HAVE BEEN MADE IN AN ENVIRONMENT WHERE NUTS OR NUT OILS ARE USED,  AND MAY NOT BE SUITABLE FOR NUT ALLERGY SUFFERERS.

CHOCOLATES:
Our boxes of chocolate may contain a mixture of types and flavours, the flavours are chosen at random but each box will always contain the same number and mix of types shown in the photographs and e-shop. Boxes and packaging will be used as shown, but it may be neccessary at times to replace them with similar ones.

ORDERING:
POSTAGE IS TO UK MAINLAND & BFPO ONLY... Should you reside abroad and still wish to buy from us please call or e-mail before ordering and we will try to accomodate you.
Cocoature must receive whole payment of the price for the products that you order before your order can be accepted. Once payment has been received by us Paypal will confirm with you that payment has been made and that we are then able to process your order. Where the customer pays with WorldPay, we will begin to process your order once we recieve it. Our acceptance of your order brings into existence a legally binding contract between us.  

Customers are requested to check and confirm they have entered the correct delivery address at the time or ordering. Should there be any error in the details provided for the recipient or for the amount to pay, we cannot be held responsible for the failure to deliver. Charges related to forwarding or reshipping the package to another recipient or to a different delivery address will be the responsibility of the customer.

Cocoature will check and approve all orders before committing to the order. Orders are dispatched within 3 working days (excluding Saturdays and Sundays) or 10 days for personalised items or special orders, we will confirm this with you at the time of ordering if more than 3 days.

If there is a problem with the order, we will e-mail you within 2 working days (excluding Saturdays and Sundays). In the event that we cannot satisfy your order due to stock or unavailability, we will contact you to offer you an alternative. which will be of equal or better quality than originally ordered.

SHIPPING & DELIVERY

We have no control over the temperatures during the delivery of your order and cannot accept responsibility for any chocolate that have been heat or cold  damaged.

We use Royal Mail small package delivery as a minimum standard on all orders.
Where the value and size of the package warrants it we will upgrade the delivery to special delivery at no extra cost to you.
Upon delivery of the order, the customer must always check that the delivery contains the exact items they ordered. Any damage or shortage must be noted accurately, dated and signed on the delivery note. We always recommend writing "unexamined" on the delivery note if you do not have time to fully check the state of the parcel there and then.
If there is nobody to receive the delivery, the item will be returned to your Royal mail delivery depot, the Postman will have left you a card telling you where and when it can be collected. At your request your delivery can be left somewhere secure, such as a porch, garage etc, but you do so at your own risk,  and Cocoature can not be held responsible for it's damage or loss.

Any claims must be made within a maximum time of 3 days after reception of the parcel by email. After this period, no claims will be accepted.
        * Please note that the pictures on our site may be of products that we no longer sell, and the image is merely showing the type of product sold, not the actual product.
        
Any return of a product must be formally agreed between Cocoature and the customer and be returned within 48 hours of the agreement. After this period, no return will be accepted.

 

RETURNS / REFUNDS
All goods can be returned within 7 days of receipt, For a full refund, excluding P&P, return the goods in the same condition that they were received in, ALL products must be UNOPENED. For hygiene reasons, any products opened by you cannot be returned unless faulty or spoiled.
The customer is responsible for the cost of postage and packing. Refunds will be given at the discretion of the Management.

CANCELLATION
You may cancel your order with us for the products you order at any time up to the end of the eighth day from the date you receive the ordered products.
You do not need to give us any reason for cancelling your order nor will you have to pay any penalty, but this must be in the form of writing or e-mail.

Once you have notified us that you are cancelling your order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.
 Once the order is packaged and handed over to the carrier, no modifications or cancellations may be accepted and the charges will not be refunded unless the returns procedure is implemented once received.

DAMAGED GOODS
Please let us know if goods arrive damaged or if there are any other problems within three days.

CHOCOLATE WORKSHOPS BOUGHT ONLINE

Chocolate workshops are for a maximum of 4 people per class for the 2 or 5 hour, and a maximum of 2 people for the full day class, and have a minimum attending age of 10 years old.
Please call the shop to enquire about available dates prior to paying online. Payment for a workshop must be received before you can consider your workshop date booked, until that time other customers may book those dates.
You may cancel a workshop booking within 8 days of booking for a full refund, unless you are within 14 days of your booked date, in which case no refund will be given but at the discretion of 'Cocoature' you may choose another date, the new date must be within 6 months of the original workshop date.
For advanced bookings who wish to cancel their workshop,  we will refund fifty percent (50%) of the price if you cancel in writing fourteen (14) days or more before the first day of the class. No refunds will be given for cancellation within fourteen (14) days of the first day of the class, but dates may be changed as mentioned above.
Your booking may not be split and some parties be on a different date, a booking encompasses all places booked, regardless of how many.

If you are unable to attend the workshop for any reason, you must let Cocoature know within 72 hours of the class beginning , and we will do our best to accommodate  you with another date. Failure to attend, or notify Cocoature that you will not be attending may result in your booking being lost with no refund or change of dates. Should any parties for the booking not attend on the booked date, then no refund or other dates will be offered to the missing parties.

All chocolates and chocolate items made in a workshop class should be consumed within 14 days unless otherwise instructed by your class chocolatier.

Cocoature have adequate Insurance whilst you are here on our premises for a workshop, but we accept no responsibility for loss of personal items.

We own the copyright to all the contents of this website, including images and designs. All trademarks and other intellectual property are owned or licensed by us (unless otherwise specified) or are the property of third parties supplying us goods for sale through this website.

You may not copy, reproduce, distribute, republish, download, display, post or transmit any part of the website without express written consent from us (except as stated below).

You may print or download any page(s) for your own personal and non-commercial use only. If you have any doubts about what you can do, please go to our Contact Us page to apply for permission to reproduce the website.

We cannot guarantee that the website is free from computer viruses, and you should take your own precautions in this respect.

We cannot be held responsible for the contents of such websites and cannot make any guarantees in respect of them. TERMINATION OF THE WEBSITE OR SERVICES

We reserve the right to terminate the website or remove any of the services on it with immediate effect at any time, for example if:

    * there is a change in the law that limits our ability to provide the website
    * an event beyond our control stops us providing the website (eg: technical difficulties)


We reserve the right to change these Terms & Conditions of Use from time to time.  If you do not wish to be governed by the revised Terms & Conditions of use, please stop using the website.

LIABILITY
We take no responsibility for any loss or damage caused as a result of our goods, except as required by law, even if we could have foreseen the loss, or the possibility of it was brought to our attention.

WE REMAIN LIABLE FOR:

    * Loss, damage, death orpersonal injury resulting from our negligence.
    * Fraudulent misrepresentations.
    * The quality of our goods.
   

GENERAL
These Terms & Conditions of use are governed by the law of England. We agree to use the courts of England,  if there is any dispute between us.

If any part of these Terms & Conditions of use is found to be invalid by law, the rest of them remain valid and enforceable.



DATA PROTECTION
Your contact and address details will be held by Cocoature in a programme that solely prints address labels. Your information will never be passed to third parties or used in such a way as to produce electronic or paper format “Spam”.
Your card details are not held or even seen by us but are used solely by WorldPay or Paypal to make the sale transaction.
